By registering, making a purchase, or using any of our services (web hosting, VPS, game servers, dedicated servers), you automatically accept these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and baires.host.
2. Services Description
baires.host offers the following services:
- Web hosting with SSD storage
- VPS servers (Virtual Private Server)
- Game servers (Minecraft, CS2, FiveM, etc.)
- Dedicated servers (Bare Metal)
- Domain and SSL services
3. Account Registration
To use our services, you must create an account by providing accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your account information is up to date
4. Payment Terms
Pricing: All prices are expressed in US dollars (USD) or Argentine pesos (ARS) as applicable. Prices may change at any time, but changes will not affect already contracted services during the current billing period.
Billing: Services are billed monthly, quarterly, semi-annually, or annually according to the selected plan. Payment is made in advance. If payment is not received by the due date, the service may be suspended or canceled.
Refunds: We offer a 7-day money-back guarantee for new web hosting and VPS services. Game servers and dedicated servers are not eligible for refund once activated. Refunds will be processed within 5-10 business days.
5. Acceptable Use Policy
It is strictly prohibited to use our services for:
- Illegal or fraudulent activities
- Spam, phishing, or unsolicited email activities
- Distribution of malware, viruses, or malicious software
- DDoS attacks or activities that compromise others' security
- Violation of copyright, trademarks, or intellectual property
- Content that promotes hatred, violence, or discrimination
- Cryptocurrency mining without express authorization
Violation of this policy may result in immediate suspension or cancellation of your account without refund.
6. Service Level Agreement (SLA)
Uptime: We guarantee 99.9% uptime for our web hosting and VPS services. If we fail to meet this SLA, we will provide service credits according to our SLA policy.
Maintenance: We perform scheduled maintenance with at least 48 hours prior notice. Emergency maintenance may be performed without prior notice when necessary to protect the security or stability of our services.
7. Data Backup and Loss
Although we perform regular backups of our services, the client is responsible for maintaining their own backups of important data. baires.host is not responsible for data loss due to:
- Client actions or user errors
- Hardware or third-party software failure
- Cyber attacks or security breaches
- Natural disasters or events beyond our control
8. Cancellation and Termination
Cancellation by Client: You may cancel your service at any time through the control panel or by contacting our support team. Cancellation will be effective at the end of the current billing period. No refunds will be issued for unused periods, except as set forth in our refund policy.
Termination by baires.host: We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these terms, engage in illegal activities, or if your account poses a risk to our services or other clients.
9. Limitation of Liability
To the maximum extent permitted by applicable law, baires.host shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from the use or inability to use our services.
Our total liability shall not exceed the amount paid by the client in the 12 months prior to the event giving rise to the claim.
10. Intellectual Property
All intellectual property rights related to our services, including but not limited to software, trademarks, logos, design, and content, are the exclusive property of baires.host or its licensors. No license or right to use these elements is granted without express written authorization.
11. Modifications to Terms
baires.host reserves the right to modify these terms at any time. Modifications will take effect immediately after their publication on our website. It is your responsibility to periodically review these terms. Continued use of our services after any modification constitutes your acceptance of the modified terms.
12. Governing Law and Jurisdiction
These terms shall be governed and construed in accordance with the laws of the Argentine Republic, without regard to its conflict of law provisions. Any dispute arising from or related to these terms shall be submitted to the exclusive jurisdiction of the courts of the Autonomous City of Buenos Aires, Argentina.
